地下空间利用立法与管理问题的核心是对“地下空间权”以及“相邻关系”的处理。通过立法确立“地下空间权”，体现公平最大化原则，可以从法理上占据主动。但现行体制下对产权复杂的空间领域的管理仍然是难点，有待研究。 - 关键词：
地下空间；立法；管理 - Abstract: How to deal with the¡°underground
space rights¡± and ¡°the neighborhoods¡± is the key
to the problem of the legislation and management
of underground space. We can establish
¡°underground space rights¡±by legislation to
maximize the equity, so that taking the initiative
in nomology. But there¡¯s still some difficulty
when it comes to the management of the
complex space property rights under existing
system and the problem need lucubrating.
