传统村落古建民居认保制度在我国部分地区已探索十余年，逐渐成为乡土建筑遗产保护与利用的重要制度，核心是将部分产权转移以提高文化遗产资源利用效率，并降低保护成本与风险，但在制度实践过程中却遭遇诸多困境而发展滞缓。因此，文章引入新制度经济学视角，对我国传统村落古建民居认保制度进行解析，发现存在行为主体参与动力不足、制度内部产权关系复杂以及制度外部环境阻力较大等问题。基于此，提出优化认保制度设计、强化法律保障体系、明确权力责任边界、完善认保补偿机制、拓展公众参与渠道、构建认保网络平台等出路，以强化认保制度对传统村落文化遗产保护的效力。 - 关键词：
传统村落；认保制度；古建民居；新制度经济学； - Abstract: Adoption & Protection System (APS) has been explored for more than a decade in China, and has gradually become an important system for the protection and utilization of vernacular architectural heritage. The core is to transfer part of property rights to improve the utilization effi ciency of cultural heritage resources and reduce protection costs and risks, but it encountered many diffi culties and slow development in the process of institutional practice. Therefore, this paper introduces the perspective of New Institutional Economics to analyze APS of the ancient architecture and dwellings in traditional Chinese villages, and fi nds that there are some outstanding problems, such as the lack of motivation of actors’participation, the complexity of property rights within the system, and the greater resistance of the external environment of the system. Based on this, this paper proposes to optimize the design of APS, strengthen the legal protection system, clarify the boundary of power and responsibility, improve the adoption & protection compensation mechanism, expand the channels of public participation, and construct the network platform for the protection of cultural heritage in Chinese traditional village.
