我国第四次宪法修正案对土地征收的依据、方法及补偿做出了规定，体现了国家对土地征用和征收制度的重视。保障人权作为宪法的最终目标，对被征地农民权益保障提出了更高的要求。本文旨在宪法的指导下，对被征地农民权益保障的途径提出三点设想：首先，依法制定严格的土地征收制度；其次，建立公平合理的土地补偿制度；第三，健全社会保障体系。 - 关键词：
土地征收；土地补偿；社会保障； - Abstract: The Fourth Amendment of our state constitution has revised the foundation, methods and compensation for the land requisition, for which the state has a regard. Because respecting and preserving human rights is the final target for the constitution, we should do much more to protect the farmers?rights and interests, whose land have been expropriated or requisitioned. The aim for this article is to put forward three ideas, according to the constitution, which preserve those farmers?rights and interests, including: (1) formulating a very strict system for the land collecting in accordance with law;(2)establishing a fair and reasonable land requisition system;(3) strengthening the social security system.
