政府是城市居住条件得到实质性改善所必需的资源的唯一持有者，政府在保障性住房建设中具有不可替代的地位与作用。保障性住房建设既是政府的政治责任也是政府的法律义务。保障性住房建设对于保障公民住宅权的实现，促进社会和谐稳定，拉动内需，平抑房价飞涨，促进房地产市场的平稳健康发展具有重要的意义。提高与增强地方政府在保障性住房建设上的内在动力与法律责任，需要建立相应的激励机制与法律责任追究机制。 - 关键词：
保障性住房；政府法律责任； - Abstract: The government is the only institution who has the resources needed for the substantial improvement of urban housing condition, so the government has unsubstitutable role in the building of indemnificatory housing. The building of indemnificatory housing is not only a political responsibility but also a legal obligation. The indemnificatory housing building can contribute greatly to the realization of civics housing right, the social stability and harmony, the expanding of internal demand, putting a curb on the rising house price, and the healthy development of real estate. In order to build and enhance the internal dynamics and legal responsibility for the government on the building of indemnificatory housing, it is needed to set up related incentive mechanism and legal responsibility running mechanism.
