西方主流学界中的产权与所有权在理论上具有相异性与缠合性，实践中西方注意到产权与所有权基本内涵上存在的区隔，对房地产使用所有权而非产权。我国的房地产离开了产权是指使自己或他人受益或受损的权利的应然内核与所有权不做区分使用，进而将原来的房地产产权大小之分附加了国情色彩，致使现实中大产权房遵循资本优先价值向度，其精神不符合公民适足住房权要求，小产权房尤其是建造于农村宅基地的小产权房，则具有较强的人权性价值。 - 关键词：
房地产；产权；内核；阐释； - Abstract: The theoretical relatedness of the property rights and the ownership is the dissimilarity and relevance in the mainstream western academic. Because of the distinction about the basic connotation of the property rights and the ownership, the real estate uses the concept of the ownership in the west. The Chinese real estate discards the natural theory connotation that the property rights convey to benefit or harm oneself or others, and doesn’t distinguish between the property rights and the ownership. The property rights of the real estate is integrated with the Chinese special conditions. The houses with formal property rights abides by the value dimension of capital, so its essence can't meet the demand of the right of adequate housing for the private citizens. The houses with limited property rights which was constructed on the rural homestead in particular have the value of human rights.
