    土地增值收益分配制度改革是深化土地制度改革的重点,近年来土地收益分配的问题已凸显并成为征地过程中社会矛盾和冲突的主要诱因,因此建立公平合理的土地增值收益分配机制是保护农民土地财产权益的重要保障。本研究以辽宁省某经济技术开发区为例,通过调研数据分析得出,当前该区域的土地增值收益在农民、政府和开发商之间的分配比例约为1:11:5,农民仅获得约6% 的土地增值收益,无法保障农民充分的土地财产权益和长远生计,而以土地发展权理论为指导测算三者之间的土地增值收益分配比例约为1:2:1,农民可获得约25% 的土地增值收益。研究结果表明:土地发展权是农民维护自身利益的重要财产权利,可作为土地增值收益分配的重要理论和实践指导;农民应直接参与或享受到土地增值收益分配权力和福利,降低政府对土地征收权和土地出让权的双重垄断地位;实证分析得出地方政府至少应拿出15%的土地增值收益补贴农民和农村,表明地方政府应将更多地土地增值收益惠及农民和农村。

  • Abstract: The key factor for the enhancement of land systematic revolution is the distribution system of land increment income. Recently, problems regardingthe distribution of land revenue have become more serious, and become the main reason for social conflicts in the process of land expropriation. As a result, the establishment for fair distribution mechanism of land increment income will prove to be a crucial protection for land property owned by farmers. Take an Economic-technological Development Zone in Liao Ning as an example. According to the data, it was analyzed that the distribution ratio of land increment income between farmers, governments and developers is 1:11:5. It indicated that mere 6% gain of it was allotted to farmers, and can hardly guarantee their sufficient land property interests. Farmers may not even make a living in the long run. Actually,with Land Development Right Theory as guideline, the ratio of land increment income between the three entities should be 1:2:1. In this case, farmers could gain 25% of the income.In summary, the surveyors demonstrate that firstly, Land Development Right is an important right for farmers to maintain their own interests. What is more, it can be a significant theory as well as practice instruction for the distribution of land increment income. Secondly, farmers should directly participate in or take the advantage of the distribution right and privilege of land increment income. By doing this, farmers could weaken the governments’ status of double monopoly on rights for land expropriation and authority for conveyance of real estate. Last but not least, local governments should offer 15% of land increment income at least to farmers and country via subsidy. In fact, more benefits from local governments to them should be favorable.
