当前，农村集体违法建设形势严峻，直接影响我国新型城镇化目标的实现。究其原因，城乡二元土地制度所带来的土地违法暴利是其诱因。同时，现行“乡政村治”制度执行不力，农村集体组织职能异化、财权事权失配严重、集体干部相关激励机制缺乏等，都使得农村集体违法建设在所难免。因此，要解决农村集体违法建设，必须对现行农村土地制度进行系统化改革，同时进一步落实农村自治制度，并对农村集体组织进行针对性改革。 - 关键词：
农村集体；违法建设；动因；对策； - Abstract: Now the illegal construction led by the rural collective has been a serious problem and directly impacts the implementation of new urbanization in China. The huge profits of the illegal construction caused by the urban and rural land system is the basic reason. And in addition, under the policy of “the force owned by the township government and the autonomy owned by the rural”, the rural collective thoroughly mutates, and faces the defect of the mismatch between its financial and affairs, the village cadres lack the related incentives .All of this caused the fact that the rural collective has no choice but to be illegal. So we must reform the land system, fully carry out the policy of “rural collective have the right of autonomy”, and reform the rural collective according to its problems.
