控规调整是控规实施的修正、适应和优化机制。由于城市规划专业和控规调整这一管理事务的特殊性，控规调整的管理不得不在很大程度上依赖于管理者的行政裁量。在制度机制尚不健全的情况下，管理者的行政裁量极有可能发挥消极的作用，导致其未能承担好主要的责任，令控规调整的实施效果偏离了制度原旨。立足当下，控规调整管理的改革重点应着眼于如何令管理者的行政裁量在更大程度上发挥积极的作用。为此，本文借助公共管理和公共行政学的相关理论，系统阐述了作为公共利益和城市利益“代理人”的管理者在控规调整管理中的主要责任，以及实现责任所面临的困境和来自行政裁量的威胁，并进一步探讨了适合于控规调整管理的行政裁量控制途径，提出了在“正当程序”基础上，以完善“实质内容”为核心的制度机制方案。 - 关键词：
控制性详细规划；控规调整；公共管理；公共利益；行政责任；行政自由裁量；正当程序；实质正义； - Abstract: Regulatory plan adjustment is a modified, adapted and optimized mechanism for regulatory plan implementation. Due to the specificity of this management for urban planning and regulatory plan adjustment, the management for regulatory plan adjustment has to largely depend on the administrative discretion of the regulators. Under the circumstance wherein institutional mechanism is not complete, it is very possible that the administrative discretion of the regulators has a negative effect, which causes that the regulators to fail to take their primary responsibility, making the results of implementation for regulatory plan adjustment diverge from the objective of institution. Therefore, the reform in the management for regulatory plan adjustment should focus on how to make the administrative discretion of the regulators play a positive role to a larger extent. For this purpose, by means of the relative theories in public regulation and public administration, the present thesis systematically discusses the major responsibility of the regulators who represent the “agents” for public benefit and urban interest in the management for regulatory plan adjustment, and the dilemma the regulators faced when playing their role as well as the threat from administrative discretion. Furthermore, a control pathway of administrative discretion adapted for the management for regulatory plan adjustment is discussed. Finally, a project of institutional mechanism improving “substantial contents” on basis of “due process” is provided.
