在我国地下空间法律缺失的背景下，一些地方立法为适应实践需要而规定了地下空间连通义务。运用价值分析法、规范分析法、实证分析法对地下空间连通义务的现行立法进行评析，其具有正当性。义务的客体范围应包括有通行必要的所有相邻地下工程，建设单位、相邻地下工程所有权人和政府相关部门作为地下空间连通义务的主体，履行相应出资和建设义务。地下连通工程所有权由投资者享有，违反地下空间连通义务，应承担行政责任和民事责任。 - 关键词：
城市地下空间；地下连通工程；连通义务；相邻关系； - Abstract: Under the background of the lack of law in China's underground space, some local legislation stipulates the underground space connecting obligation to meet the needs of practice. Using the value analysis method, normative analysis method and empirical analysis method to evaluate the current legislation of the underground space connecting obligation, it is found that the connecting obligation stipulated by the current local legislation has legitimacy and rationality, but it needs to be specific and fulfilled. The scope of the object of the obligation shall include all adjacent underground works necessary for the passage, and the construction unit, the owner of the adjacent underground engineering and the relevant government department shall act as the principal part of the underground space connecting obligation which perform the corresponding capital contribution and construction obligations. The ownership of the underground connecting engineering shall be enjoyed by the investor. Anybody shall be subject to administrative and civil liability in violation of the underground space connecting obligation.
