国际地质学界普遍认为21 世纪是开发利用地下空间的世纪，随着我国地下空间工程数量的大幅增加，因权属关系不明而造成的地下空间产权纠纷接踵而至。当下地下空间分层开发是解决权属问题最为有效的方式，文章以“分层—确权”制度为研究对象，借鉴国内外地下空间法律制度与开发经验，整合空间、时间和关系三维属性，构建基于竖向分层、水平分区的一体化分层开发体系，试图在开发体系与权属制度间建立耦合关系。结果表明：立体化分层开发体系的建立有助于判别土地开发权的取得方、权利与义务的关系，便于从使用期限、土地范围、用地条件三个方面进一步明确地下空间确权制度，从而有助于我国地下空间法律制度的建立与完善。 - 关键词：
地下空间；一体化；分层开发；权属制度； - Abstract: The international geological community generally believes that the 21st century is the century of development and utilization of underground space. With the substantial increase in the number of underground space engineering projects in China, property rights disputes come one after another caused by unclear ownership relationship between the ground and underground, underground and underground. The integrated and stratifi ed development model of underground space provides an effective theoretical support for the establishment of property rights system. The article draws lessons from the domestic and foreign underground space legal system and construction experience. Through integrating the three attributes of space, time and relationship, the results show that the establishment of three-dimensional hierarchical development system is helpful to distinguish the relationship between the right to land development, rights and obligations, and to further clarify the system of confi rming the right to underground space from three aspects: the duration of use, the scope of land and the conditions of land use. This will help to establish and improve the legal system of underground space in China.
